1. Agreement to Terms

By accessing or using SharpScore (https://sharpscore.io), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.

2. Service Description

SharpScore is an AI-powered IELTS mock exam practice platform. The Service provides simulated speaking, listening, reading, and writing practice tests with AI-generated scoring and feedback.

SharpScore is NOT an official IELTS test. Scores generated by SharpScore are AI estimates for practice purposes only and do not represent actual IELTS Band Scores. SharpScore is not affiliated with, endorsed by, or associated with the British Council, IDP Education, or Cambridge University Press & Assessment. IELTS is a registered trademark of its respective owners.

3. Eligibility

You must be at least 16 years old to use SharpScore. By using the Service, you represent that you meet this age requirement.

4. Account Registration

To access certain features, you may need to create an account. You are responsible for:

• Providing accurate registration information
• Maintaining the confidentiality of your account credentials
• All activities that occur under your account

5. Free and Paid Services

Free Tier

SharpScore offers limited free access to its features. Free usage limits may change at any time without prior notice.

Paid Subscriptions (Pro / Max)

• Paid plans are billed monthly through our payment processor
• Prices are listed in USD and may vary by region
• Your subscription renews automatically each billing cycle unless cancelled
• You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period
• No partial refunds are provided for unused portions of a billing period (subject to the Refund Policy below)

Early Access Period

During our Early Access period, paid features may be available for free. We reserve the right to begin charging for these features with at least 7 days' notice via email.

6. Payment Processing and Merchant of Record

All payments are processed by Lemon Squeezy, which acts as the Merchant of Record for all transactions. This means:

• When you make a purchase, you are buying from Lemon Squeezy, which is an authorized reseller of SharpScore
• Lemon Squeezy handles payment processing, sales tax collection, and PCI compliance
• Lemon Squeezy's Buyer Terms and Conditions also apply to your purchase (available at lemonsqueezy.com/buyer-terms)
• Billing inquiries should be directed to privacy@sharpscore.io

7. AI-Generated Content Disclaimer

All scores, feedback, and assessments provided by SharpScore are generated by artificial intelligence and are estimates only. Specifically:

• AI scoring may not accurately reflect your actual IELTS performance
• Professor Sharp adopts a conservative scoring approach; scores may be lower than your actual IELTS result
• AI-generated feedback should be used as a supplementary practice tool, not as a definitive assessment of your English proficiency
• SharpScore does not guarantee any specific score improvement on the actual IELTS exam
• We do not make any claims about score prediction accuracy
• Practice test questions are original AI-generated content and are not sourced from official IELTS test materials

8. Voice and Audio Data

The Speaking practice feature uses real-time voice conversation with AI. By using this feature:

• You consent to your voice being transmitted to our AI service providers (Google Gemini) for processing
• Voice data is processed in real-time and is not permanently stored by SharpScore
• Our AI service providers may process your data according to their own privacy policies
• Please refer to our Privacy Policy for full details on data handling

9. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to reverse-engineer, decompile, or extract source code from the Service
• Use automated tools (bots, scrapers) to access the Service
• Share your account credentials with others
• Resell, redistribute, or commercially exploit the Service
• Attempt to bypass usage limits or access restrictions
• Upload harmful, offensive, or illegal content through the writing practice feature
• Interfere with or disrupt the Service or its infrastructure
• Use the Service to prepare fraudulent IELTS test results or engage in academic dishonesty

10. Intellectual Property

• All content, design, code, and AI models used in SharpScore are owned by SharpScore or its licensors
• Practice test questions are original content created by SharpScore and are not copied from official IELTS test materials
• You may share your score reports for personal use but may not use them for commercial purposes
• The SharpScore name, logo, and “SHARP” scoring framework are proprietary to SharpScore

11. Indemnification

You agree to defend (at our request), indemnify, and hold harmless SharpScore and its employees, officers, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or connected with: (i) your access to or use of the Service; (ii) your breach of these Terms; (iii) your violation of any third-party right; or (iv) your violation of any applicable laws or regulations.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• SharpScore is provided “AS IS” and “AS AVAILABLE” without warranties of any kind
• We do not warrant that the Service will be uninterrupted, error-free, or secure
• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability to you shall not exceed the amount you paid to SharpScore in the 12 months preceding the claim
• We are not responsible for any decisions you make based on AI-generated scores or feedback

13. Force Majeure

SharpScore shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to: acts of God, natural disasters, pandemic, war, terrorism, government actions, third-party service outages (including but not limited to Google Gemini, Anthropic Claude, Lemon Squeezy, Vercel), internet disruptions, power failures, or cyberattacks.

14. Service Availability

• We may modify, suspend, or discontinue any part of the Service at any time
• We will make reasonable efforts to notify users of significant changes
• AI features depend on third-party services (Google Gemini, Anthropic Claude) and may be affected by their availability or policy changes
• Scheduled maintenance will be communicated in advance when possible

15. Termination

• You may delete your account at any time by contacting privacy@sharpscore.io
• We may suspend or terminate your account if you violate these Terms
• Upon termination, your right to use the Service ceases immediately
• Provisions that by their nature should survive termination will survive (including Sections 10, 11, 12, 13, and 16)

16. Dispute Resolution

• You agree to contact SharpScore at privacy@sharpscore.io before initiating any formal dispute, chargeback, or legal proceeding
• We will attempt to resolve any dispute informally within 30 days of your notice
• If informal resolution fails, disputes shall be resolved in the courts of Singapore
• You agree not to initiate a chargeback or payment dispute without first contacting us and allowing 14 days for resolution

17. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on the Service and updating the “Last Updated” date. Your continued use after changes constitutes acceptance. For material changes affecting paid subscribers, we will provide at least 14 days' advance notice via email.

18. Governing Law

These Terms are governed by the laws of Singapore. Any disputes shall be resolved in the courts of Singapore.

19. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
